OVERVIEW
Welcome to SnailSpeed. Zenthium, LLC DBA SnailSpeed ("SnailSpeed," "we," "us," or "our") operates this website and online store.
These Terms of Service, together with any policies referenced herein (collectively, the "Terms"), govern your use of our website, online store, content, features, tools, and related services (collectively, the "Services"), as well as your purchase and use of products sold by SnailSpeed (the "Products").
SnailSpeed is powered by Shopify, which provides technology that enables us to offer the Services and sell Products to you.
Please read these Terms carefully. They contain important information concerning your legal rights and obligations, including warranty disclaimers and limitations of liability.
By visiting, interacting with, or using the Services, or by purchasing Products from SnailSpeed, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use the Services or purchase Products from SnailSpeed.
SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms, you represent that you are at least the age of majority in your jurisdiction of residence, or that you are the age of majority and have consented to your minor dependents using the Services on devices you own or manage.
You may be asked to provide information including your email address, billing information, payment information, and shipping information. You represent that all information you provide is correct, current, and complete.
You are responsible for maintaining the security of your account credentials and for activity conducted through your account. You may not transfer, sell, assign, or license your account to another person.
SECTION 2 - PRODUCTS, DESCRIPTIONS, AND FITMENT
We make reasonable efforts to accurately describe and represent our Products. Colors, finishes, appearance, dimensions, and other characteristics may vary due to display settings, lighting, production tolerances, or other factors.
Product descriptions, specifications, pricing, fitment information, and availability may change without notice.
Vehicle manufacturers may make production, regional, or mid-model-year changes, and previously installed modifications may affect fitment. Customers are responsible for accurately identifying their vehicle and reviewing stated fitment requirements before purchase.
Published horsepower, torque, temperature, flow, acceleration, dyno, or other performance results reflect specific testing conditions and are not guarantees of identical results on every vehicle unless expressly stated otherwise. Actual results may vary based on vehicle condition, modifications, calibration, fuel, drivetrain, atmospheric conditions, installation, and other variables.
We reserve the right to modify or discontinue Products and to limit quantities sold to any person, business, reseller, geographic region, or jurisdiction.
SECTION 3 - ORDERS, VENDORS, AND COMMERCIAL CUSTOMERS
When you place an order, you are making an offer to purchase. SnailSpeed may accept or decline an order in its discretion, subject to applicable law. An order is accepted when payment has been processed and we confirm the order.
Please review your order carefully before submitting it, as we may be unable to accommodate cancellation or modification requests after processing or fulfillment begins.
Purchases are subject to our Refund Policy.
SnailSpeed sells Products to consumers as well as automotive shops, dealers, vendors, installers, commercial customers, and authorized resellers. Purchases for authorized commercial resale are permitted.
Separate vendor, wholesale, dealer, distributor, reseller, purchase-order, or commercial terms may apply to business-to-business transactions. If a separate written agreement conflicts with these Terms, the separate agreement controls to the extent of that conflict.
SECTION 4 - TWO-YEAR LIMITED WARRANTY
Unless expressly stated otherwise, new SnailSpeed Products are covered by a Two-Year Limited Warranty against defects in materials and workmanship under normal and reasonably intended use.
For Products purchased directly from SnailSpeed, the warranty period begins on the original purchase date. For Products purchased new from an authorized SnailSpeed dealer or reseller, the warranty period begins on the original retail purchase date by the end customer. Dealer or reseller acquisition of inventory does not begin the end customer's warranty period.
This Limited Warranty applies to the original retail purchaser or end customer. Proof of purchase may be required.
If SnailSpeed determines that a Product has a covered defect during the warranty period, SnailSpeed will, at its option, repair the Product, replace it with the same or a substantially equivalent Product, or refund the purchase price when repair or replacement is not reasonably available.
This warranty does not cover damage or failure caused by improper installation, misuse, abuse, neglect, accident, collision, unauthorized modification of the Product that causes or contributes to the failure, improper maintenance, contamination, incompatible components, improper tuning or calibration, electrical or wiring faults, improper fluids or chemicals, ordinary wear, or operation outside the Product's intended purpose.
The use of aftermarket components, independent installers or repair facilities, vehicle modifications, tuning, track use, motorsports use, or performance driving does not by itself void this warranty. Coverage may be denied when such a condition caused or contributed to the claimed failure.
Unless expressly stated otherwise, this warranty covers the Product itself and does not include removal or installation labor, diagnostic charges, towing, vehicle downtime, rental vehicles, transportation, lost income, or costs associated with unrelated components, except where applicable law requires otherwise.
To obtain warranty service, contact SnailSpeed using the information in Section 24 before returning the Product. Provide proof of purchase, a description of the issue, and any reasonably requested photographs, video, logs, or diagnostic information. SnailSpeed may require inspection or return of the Product before approving warranty service.
This is a Limited Warranty. To the extent permitted by law, any implied warranty, including the implied warranties of merchantability or fitness for a particular purpose, is limited in duration to the two-year duration of this Limited Warranty.
Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.
To the extent permitted by law, SnailSpeed is not responsible under this Limited Warranty for incidental or consequential damages resulting from the failure of a warranted Product.
Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
SECTION 5 - AUTOMOTIVE PRODUCTS AND VEHICLE MODIFICATIONS
Automotive modification changes a vehicle from its original factory configuration and may affect the operation, durability, emissions characteristics, safety systems, manufacturer warranty, or performance of the vehicle.
Certain Products may require mechanical, electrical, fabrication, or calibration skills. Customers are responsible for ensuring proper installation and should use a qualified technician when appropriate.
SnailSpeed is not responsible for failure of pre-existing, worn, damaged, improperly maintained, improperly modified, or incompatible vehicle components.
Where tuning or calibration is required, the customer is responsible for obtaining an appropriate calibration from a qualified source. If SnailSpeed expressly states that tuning is not required for a particular Product and application, that representation remains part of the Product description.
Certain Products may be intended for spirited driving, track use, motorsports, or modified vehicles. Such use does not automatically void the Product warranty, but the warranty does not cover crashes, over-revving, detonation, excessive boost, improper tuning, overheating caused by another system, or mechanical loading outside the Product's intended operating range.
Automotive equipment, emissions, inspection, registration, and noise laws vary by jurisdiction. Customers are responsible for determining whether installation and use of a Product are lawful for their particular vehicle and location.
A Product specifically identified for competition, racing, off-highway, or other restricted use must be used in accordance with that designation and applicable law. SnailSpeed does not authorize unlawful tampering with required emissions-control or safety equipment.
Customers should inspect modified vehicles periodically and discontinue operation when an abnormal condition could reasonably cause damage or create a safety hazard.
SECTION 6 - PRICES AND BILLING
Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect when the order is placed, subject to correction of genuine errors as permitted by law.
Unless expressly stated otherwise, posted prices do not include taxes, shipping, handling, customs, duties, brokerage fees, or import charges.
You agree to provide current, complete, and accurate billing and payment information and represent that you are authorized to use the payment method submitted with your order.
SECTION 7 - SHIPPING, DELIVERY, AND RISK OF LOSS
Shipping and delivery dates are estimates. SnailSpeed is not responsible for delays caused by carriers, customs, weather, governmental action, or other events outside our reasonable control.
For retail orders, risk of loss or damage remains with SnailSpeed while the shipment is in transit and passes to the customer upon proper delivery to the shipping address provided with the order.
A shipment mistakenly delivered by the carrier to another address is not considered proper delivery under this provision.
After proper delivery, responsibility for theft, weather exposure, loss, or other events occurring at the delivery location passes to the customer, except where applicable law provides otherwise.
Customers are responsible for providing an accurate shipping address. If an order arrives damaged, incorrect, incomplete, or appears lost or misdelivered, please contact SnailSpeed promptly. We request notice within five days when practicable to assist with carrier investigations, but this requested period does not waive rights that cannot legally be waived.
Separate shipping or freight terms agreed to in writing for commercial, vendor, dealer, distributor, or wholesale transactions control to the extent of any conflict with this Section.
SECTION 8 - INTELLECTUAL PROPERTY
Services and Content
The Services and their content, including trademarks, names, logos, text, photographs, graphics, video, audio, software, product descriptions, documentation, design, selection, and arrangement, are owned by or licensed to SnailSpeed and are protected by applicable intellectual-property laws.
Except as permitted by law or with prior written consent, you may not reproduce, distribute, modify, republish, commercially exploit, or create unauthorized derivative works from protected SnailSpeed content.
Products and Product Intellectual Property
SnailSpeed Products may incorporate proprietary designs, engineering, specifications, dimensions, drawings, CAD data, software, firmware, documentation, packaging, trade dress, trademarks, product names, graphics, and other intellectual property owned by or licensed to SnailSpeed.
Purchasing a Product transfers ownership of that individual physical Product to the purchaser but does not transfer ownership of, or grant a license to, the intellectual property embodied in or associated with the Product except as necessary for ordinary lawful use.
Except as permitted by applicable law or with SnailSpeed's prior written consent, you may not copy, reproduce, manufacture, or commercially exploit SnailSpeed's proprietary Product designs, drawings, specifications, software, branding, or other intellectual property for the purpose of manufacturing or selling unauthorized competing or substantially similar products.
Nothing in these Terms restricts lawful repair, maintenance, modification, compatibility analysis, resale of legitimately purchased Products, or any other activity that cannot lawfully be restricted.
SECTION 9 - OPTIONAL TOOLS
The Services may provide access to third-party tools or functionality that we do not control.
Unless expressly stated otherwise, such tools are provided on an "as available" basis without endorsement by SnailSpeed. Your use of third-party tools may be subject to separate terms and privacy policies.
New features, tools, or resources offered through the Services will also be subject to these Terms unless separate terms are provided.
SECTION 10 - THIRD-PARTY LINKS
The Services may contain links to websites, Products, services, or materials provided by third parties.
SnailSpeed is not responsible for the content, accuracy, security, products, services, or practices of independent third parties. Please review applicable third-party terms and policies before entering into a transaction with them.
SECTION 11 - RELATIONSHIP WITH SHOPIFY
SnailSpeed is powered by Shopify, which provides technology used to operate portions of the Services.
Purchases made through our store are made directly with SnailSpeed. Shopify is not the seller of SnailSpeed Products merely because it provides ecommerce technology used by the store.
SECTION 12 - PRIVACY POLICY
Personal information collected through the Services is subject to our Privacy Policy.
Because portions of the Services are hosted or supported by Shopify, personal information may also be processed by Shopify and other service providers as necessary to provide ecommerce, payment, fraud-prevention, analytics, communications, fulfillment, and related services.
SECTION 13 - FEEDBACK AND REVIEWS
If you submit reviews, photographs, videos, ideas, suggestions, or other feedback relating to SnailSpeed or its Products ("Feedback"), you grant SnailSpeed a worldwide, perpetual, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display that Feedback for lawful business purposes.
You represent that you own or have the rights necessary to submit the Feedback and must disclose compensation or incentives associated with reviews or endorsements when required by law.
We may remove Feedback that violates law, another person's rights, or these Terms. You remain responsible for the accuracy and lawfulness of Feedback you submit.
SECTION 14 - ERRORS, INACCURACIES, AND OMISSIONS
The Services may occasionally contain errors or omissions relating to Product descriptions, compatibility, pricing, promotions, shipping, transit times, inventory, or availability.
Subject to applicable law, SnailSpeed may correct errors and update information. If a material error affects an order already submitted, we may contact you with corrected information and, when appropriate, allow you to proceed with or cancel the affected transaction.
SECTION 15 - PROHIBITED USES
You may use the Services only for lawful purposes.
You may not use the Services to violate law; infringe intellectual-property rights; harass or unlawfully harm another person; transmit false or deceptive information; upload malware; send spam or phishing communications; impersonate another person; access accounts or nonpublic information without authorization; commit payment fraud or fraudulent chargebacks; circumvent authentication, security, or access controls; or materially disrupt the operation of the Services.
We may restrict or terminate access when we reasonably determine that a user has violated these Terms or presents a fraud, security, operational, or legal risk.
SECTION 16 - SEARCH ENGINES, CRAWLERS, AND AI AGENTS
SnailSpeed supports legitimate product discovery and does not intend these Terms to prevent lawful search engines, AI search systems, shopping agents, accessibility tools, comparison services, or indexing services from discovering, indexing, analyzing, referencing, or surfacing publicly available SnailSpeed Products and content.
Automated systems may access publicly available portions of the Services for legitimate search, indexing, product discovery, comparison, research, accessibility, or customer-assistance purposes provided they comply with applicable law, respect reasonable technical controls and rate limits, do not circumvent security or authentication measures, do not access nonpublic customer information, and do not materially disrupt the Services.
Where reasonably practical, automated systems should accurately identify themselves through appropriate technical means.
Nothing in this Section grants ownership of SnailSpeed intellectual property or a license to commercially republish protected content beyond rights otherwise granted by law or SnailSpeed.
SECTION 17 - TERMINATION
SnailSpeed may suspend or terminate access to the Services when reasonably appropriate for violation of these Terms, fraud prevention, security, legal compliance, or protection of SnailSpeed, its customers, or third parties.
Termination does not eliminate obligations or liabilities accrued before termination. Provisions that by their nature should survive termination will remain in effect.
SECTION 18 - DISCLAIMER OF WEBSITE SERVICES
The Two-Year Limited Warranty in Section 4 governs covered Products and is not disclaimed by this Section.
Except for express Product warranties and rights that cannot legally be waived, the website, informational content, account features, optional tools, and other non-Product Services are provided on an "as available" basis.
We do not guarantee that the Services will always be uninterrupted, error-free, secure, or continuously available.
General information provided through the Services is not a substitute for inspection of a particular vehicle, manufacturer service information, or professional mechanical diagnosis.
SECTION 19 - LIMITATION OF LIABILITY
To the fullest extent permitted by law, SnailSpeed and its members, managers, officers, employees, affiliates, agents, contractors, and service providers will not be liable for indirect, special, exemplary, punitive, incidental, or consequential damages arising from the Services or Products, including lost profits, lost revenue, lost data, loss of use, or similar economic losses.
Nothing in these Terms excludes or limits liability for personal injury, death, fraud, willful misconduct, or any other liability that applicable law does not permit to be excluded or limited.
Where a limitation or exclusion is prohibited by law, it applies only to the maximum extent legally permitted.
SECTION 20 - INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold harmless SnailSpeed and its members, managers, officers, employees, affiliates, agents, contractors, licensors, and service providers from third-party claims, liabilities, damages, and reasonable costs arising from your material breach of these Terms, unlawful use of the Services, violation of another person's rights, or intentional misuse of a Product.
This provision does not require you to indemnify SnailSpeed for claims caused by SnailSpeed's own negligence, defective Product, breach of warranty, unlawful conduct, or other conduct for which indemnification cannot legally be required.
SECTION 21 - SEVERABILITY
If any provision of these Terms is found unlawful, invalid, or unenforceable, it will be enforced to the maximum extent permitted by law or severed where appropriate. The remaining provisions will remain in effect.
SECTION 22 - WAIVER; ENTIRE AGREEMENT
Failure to exercise or enforce a right under these Terms does not constitute a waiver of that right.
These Terms and policies incorporated by reference constitute the entire agreement between you and SnailSpeed concerning the matters addressed herein and supersede prior agreements or communications concerning those matters.
Separate vendor, dealer, distributor, reseller, wholesale, or other commercial agreements may supplement or supersede these Terms as expressly provided in those agreements.
SECTION 23 - ASSIGNMENT
You may not assign or transfer your account or obligations under these Terms without prior written consent where such consent may lawfully be required.
SnailSpeed may assign these Terms in connection with a merger, acquisition, sale, reorganization, or transfer of the business, subject to applicable law.
SECTION 24 - GOVERNING LAW; CONTACT INFORMATION
These Terms and disputes arising from them, the Services, or Products will be governed by the laws of the State of South Carolina, without regard to conflict-of-law principles, except where federal law or other applicable law requires otherwise.
Subject to rights that cannot legally be waived, judicial proceedings arising from these Terms shall be brought in an appropriate state court located in Spartanburg County, South Carolina or, where federal jurisdiction exists, the United States District Court for the District of South Carolina.
Nothing in this Section deprives a consumer of protections that applicable law requires to apply notwithstanding a contractual choice of law or venue.

Changes to these Terms will not retroactively reduce warranty rights or other rights that accrued from a Product purchased before the effective date of the change.
Continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.
